Election Commission of India Issues Strict Directives Against Use of Children in Election Campaigns

New Delhi: In a bid to maintain ethical campaign practices and uphold the rights of children, the Election Commission of India (ECI) has issued stringent directives to political parties regarding the use of children in election-related activities. The ECI has adopted a ‘Zero Tolerance’ approach towards the involvement of children in any form during the electoral process.

Prohibition of Child Participation: Political parties are explicitly instructed not to engage children in any election campaign activities, including rallies, slogan shouting, distribution of posters or pamphlets, and any other election-related activities. The prohibition extends to the use of children to create a political campaign semblance through various means like poems, songs, spoken words, or the display of party/candidate insignia.

Legal Compliance: All political parties and candidates must strictly adhere to the Child Labour (Prohibition and Regulation) Act, 1986, as amended by the Child Labour (Prohibition and Regulation) Amendment Act, 2016. The Commission stressed the significance of the Hon’ble Bombay High Court’s order, emphasizing the prevention of the participation of minor children in election-related activities.

Exception Clause: The directive clarifies that the mere presence of a child, accompanied by their parent or guardian in the proximity of a political leader and not involved in any campaigning activity, will not be considered a violation of the guidelines.

Responsibility of Election Officials: Election officials and machinery at all levels are strictly instructed to refrain from involving children in any capacity during election-related work or activities. District Election Officers and Returning Officers bear personal responsibility for ensuring compliance with relevant acts and laws related to child labor.

The Election Commission has warned that any violation of these provisions by the election machinery will result in severe disciplinary action. These directives aim to ensure a respectful and ethical election environment while safeguarding the rights and well-being of children.
